Domino's/Subway Battle Gets Legaly, Firey
Earlier this month, Subway's lawyers sent Domino's a letter asking them to stop promoting their taste test claims. According to Jeff Moody, CEO of Subway, "They are false." One of his four complaints with the test (detailed at AdWeek.com) blamed vegetables for the loss. Said the moody Moody, "They made every Subway sandwich the same and based the build on our pictures, which include all the veggies. The majority of consumers don't add all the veggies." Domino's sandwiches are notably devoid of veggies.
So what did Domino's do with that letter? They baked it, of course. Here's double-first-named Domino's CEO, David A. Brandon setting the letter ablaze in one of their pizza/sandwich ovens (video here). Said Brandon, "This is as much fun as a good, old-fashioned school cafeteria food fight."
A national taste test conducted in my imagination showed that people preferred Domino's-baked Subway legal letters 2-to-1 over Subway-baked Domino's legal letters.

I think Subway is making a mistake fighting back.
They're response falls flat for me. I would normally assume that a survey created by Domino's would obviously be biased, but if that's the bias they are discussing, then it adds credibility to Domino's claim. Subway subs have veggies and I think it is fair for them to assume so.

Subways should stick to their high ground here -- arguing that their sandwiches (including veggies) are healthier and lower-cal, which is objectively provable and indisputably true.
Of course the oiled, buttered and baked sandwiches loaded with meat and cheese taste better to most animals, including human ones, because we're genetically programmed to crave all that fat. The same people who are already choosing pizza over veggie-heavy light sandwiches are unlikely to respond to Subways' complaints about the taste test being unfair anyway, but the people who don't know the calorie count and percentage from fat on the Dominoes sandwiches might be persuaded to eat more healthily at least occasionally.

I wish that the Subway sandwiches would look, in person, closer to the pictures in the store windows and in their ads. They show you sandwiches that are loaded with meat and veggies. What you get is a long way from what they promise.
